Early Action Compact (EAC)

The EPA's Early Action Compact (EAC) allows a region to submit an enforceable State Implementation Plan outlining steps the region will take to maintain compliance with the ozone standard.  In return, the EPA will defer any potential non-attainment designation and give the area until 2007 to demonstrate attainment of the standard.

The EAC was signed by the Regional Air Quality Council, the Colorado Department of Public Health & Environment, the Colorado Department of Transportation, the Air Quality Control Commission and the Denver Regional Council of Governments in December 2002.  The U.S. EPA  signed the agreement on December 31, 2002. In early 2004 the EAC was amended to include Elbert, Larimer, Morgan and Weld Counties as signatories.

The EAC  requires the local area to identify and describe additional State and local strategies under consideration for the Ozone Action Plan by June 16, 2003.  The RAQC convened stakeholder meetings throughout the process.

The EAC Signatories submitted the Ozone Action Plan to the Air Quality Control Commission (AQCC) in March 2004 for consideration.  The AQCC approved the plan on March 12, 2004.  The Plan was unanimously approved by the state legislature during the 2004 session.  Governor Owens submitted the Plan to EPA in July 2004.
